We received a claim back in 2018 for a small penalty fine from Companies House. Unfortunately at the time I was living abroad in the Netherlands so was not aware of the debt (£482). We were in contact in the end by Optima Legal when they filed for a claim through the courts.
As post went to our old address by the the time we were informed we had one day to make the settlement before it will lead to a CCJ against the company. I contacted Optima Legal on the very day and the payment was made in full and settled. We also confirmed on that day the payment was made.
The matter we understood was concluded and the CCJ was not registered against the company because the payment was made and settled within 1 month. Despite receiving an automated receipt confirmation with transaction number that the payment was made Optima Legal confirmed the with the courts the following day that they received the payment a day later, which was not the case. The courts then filed a CCJ against the company - day after we made the payment and received the receipt.
It was only until now when we applied for a business loan we were informed that a CCJ was registered against us.
I have since written to the courts (CCBC in Northampton) and provided them with all the confirmations that the payment was made in time and settled. They have unfortunately not removed the CCJ and confirmed that they need Optima Legal to request the date is adjusted. The courts confirmed to us once they have received this the CCJ will be completely removed.
So far we are getting no solid response from Optima Legal, or even written confirmation back that they accept that the information we have provided to the court is correct.
We are in a very difficult situation as we made the payment within the 30days, provided the courts with the actual proof of receipt and confirmations from Optima that we received on the day and they are still rejecting it.
It seems completely unfair that we now have a CCJ against us and we followed the terms of payment set by the court.
Any help or advise how we can get this resolved would be greatly appreciated.
