  • JYSK UK failed unreasonably delayed delivery

    Hi All,

    A little bit of random question considering the actual format of the forum but I am toying with idea to take JYSK UK to small claims court and seek compensation due to unreasonably delayed delivery beyond time frame stipulated in their own T&C’s and beyond reasonable delivery time of 30 days as stipulated in consumers act.

    a little bit of background:

    We are expecting our firstborn to arrive any day now and in the beginning of March we’ve started decorating the nursery. By the end of March decorating was done and the only things missing were furniture. Due to lockdown being introduced on 23rd of March and all non essential shops being forced to close we were left with only one option - online shopping. We did hold back as long as we could as I’m just not a fan of buying things like furniture online but time was ticking fast and lockdown was not being eased. Therefore on 18th May we placed an order with JYSK UK for a wardrobe and on 19th of May we’ve placed an order for some shelves and draws units.

    Initial order confirmation email has stated that order will be delivered within 15 working days - FAILED.

    Their own T&C’s on their website stipulated that due Covid-19 outbreak the deliveries are being delayed and will take up to 20 working days - FAILED.

    On 2nd of June I’ve received an email saying that both orders have been shipped and will take 2-7 working days to arrive. At this point money were taken from my account.

    Surprise surprise, neither of orders arrived within promised time frame. On 19 of June I’ve sent a strongly worded complaint email outlining how much distress they are causing to my heavily pregnant partner (every word was true), on 22nd of June I’ve received a text that One of the orders is ready to be collected (no response to the email though).

    So we’ve picked up our first order and now it’s 2nd July and still no sign of our 2nd order.

    So my question is, where do I stand from legal point of view? They’ve failed to fulfil the contract and are still withholding our money so we can’t even go and buy same items from a different supplier?
