  • Mother in law wants Inheritance back!

Hi, I'm just going through a separation and are at the point where the house is sold and moneys need to be split. Several years ago my mother in law kindly cleared some credit card bills and said it would come out of our inheritance! Now my ex is claiming that her mum now wants that money back and is trying to put into place the amount going straight to her mum from the house proceeds. Can she do this?? Any advice would be so welcome.

      Hi,
unless there was an agreement in writing she would have difficulty enforcing this in my opinion, it is more of a moral dilemma I would suggest. Is the sum she paid significant? Did it help you and your wife out at the time? Has you ex mother in law approached you or is this from your ex? It may be worth holding it on the back burner as a negotiation point, a sort of ‘if I agree to pay back then you don’t get X’ Are you seeing lawyers or mediators? It would be worth discussing this with someone legal.
I am a qualified solicitor and am happy to try and assist informally, where needed.

If in doubt you should always seek professional face to face legal advice.
