The company that supply our ERP (inventory and order management) software which we use to run our business have indicated via email that they are going to issue us with a notice to terminate our contract when the next renewal comes around.
This suits us as the software is poor and since we setup with them last May (2019) it hasn't ever really delivered.*
However, our renewal isn't up until next May 2021 and we invested a considerable sum in the set up costs as well as paying an annual license fee. We would like to go our separate ways after a period of transition, say 3 months, so that we can setup with a competing product.
Given that our supplier are the ones that indicated they want to end the contract do we have any grounds to recoup any of the set up costs that we paid last year or any of the annual license fee that we have paid for last year, and in advance for this year?
