  • Where do I claim the Hearing Fee on N225?

    Afternoon everyone,

    I'm just going through the small claims court for the first time and have a couple of questions i'd really appreciate help with.*I've received a General Form of Judgement Order stating that the defendant's Defence has been struck out. It goes on to say the Claimant (me) may enter judgement for:

    1) the sum on the claim form
    2) costs on the claim form
    3) and any hearing fee paid

    I initially used a solicitor and the claim was filed at the County Court Bulk Centre, however I have taken it over myself and it is now listed at my local County Court.

    I've got as far as identifying form N225 as the mechanism to enter judgement, however I'm struggling to work out how I add the Hearing Fee Paid to the calculation box, and also where specifically I send the form to. I've tried google, searching this forum and phoning the court (no answer), however I can't find anything that helps.*

    Any advice would be greatly appreciated!

      I don't think Form N225 is appropriate here because that is a request for judgment and reply to admission. This would be used where the defendant has admitted in full or in part the amount being claim - this is why it says in Section D "Amount of claim as admitted".*

      You might be better off using Form N205A which is request for judgment following default. In terms of completing the form:

      1. I would tick section A

      2. As for the court details, the Order should say where it came from e.g. Mr District Judge sitting at the Leeds County Court ... If your case has been listed at your local court then I would submit the request for judgment at the local court.

      3. Lump the hearing fee in with the court fees, send a covering letter saying you are filing a request for judgment following the courts decision to strike out the defence and enclose the order. Explain that the order allows you to recover the hearing fee which you have paid but there was no section for it on Form N205A and so it has been added to the court fees. Just in case the court staff are having a bit of a blonde moment, it would be sensible to explain in the cover letter how much you are seeking to enter judgment for and itemise it like:

      Sum on Claim Form
      Costs on Claim Form
      Hearing Fee
