  • Personal Injury at home- question

    Hi there, after some advice
Two weeks ago a leaflet was posting leaflets on our road.

Our house is attached to next door and there is a small 'path' right in front of the houses. In the bushes here there is an old TV Ariel that the leaflet tripped over and incurred an injury.*

Today the leafleter came around and stated they want to make a personal injury claim. We only rent the house so passed on the details of the landlord, and emailed the landlord to let them know.

The Ariel has been in the bushes since before we moved in in 2016, and looking on Google maps has been there since at least 2008. Is there a case here as it was on private property? Will the landlord be liable for this?

Yes, there is a possibility of a claim .

To see who might be liable...the place to start is your tenancy agreement.
Unless it states otherwise, I believe (but am wide open to correction) that the landlord is only responsible for maintenance of* those areas of the garden which it would be unreasonable to expect the tenant to maintain.

If you have a tenant's liability insurance policy, or contents policy with public liability cover included, you should inform your insurers of a possible claim.
