  • Adding a 3rd defendant to an already allocated small claim?

    Hello,

Just wondered if adding a 3rd defendant after allocation to the small claims track and a hearing date set is possible? Would I need the consent of the other parties to do this and whats the likely cost of this?

    Thank you

can you give a little detail on the case? How close is the hearing, and what is the hearing for? Trial or case management?
Adding a party is covered by rule 19, you cant just consent to it, the courts permission is needed first. There would need to be an application so £255, and also do you even know if the Defendant will agree to being added?
