  • Nearly 2 years and still no inheritance

    So my grandad passed away in November 2018, his house was already sold and there was no debt in his estate, he did have a complicated estate with money in shares etc. We got probate finally in march 2020 but still I have not recieved any payment of the inheritance and also i was curious if someone could tell me if the net value of the estate is the amount before or after inheritance tax has been paid

    Net value is the total value of estate assets less any debts before IHT paid..

    If probate not obtained until March 2020 the executor will not distribute the estate until September 2020, as until that point claims can be made against the estate under the inheritance act.

      Thanks for clarifying the IHT point

      5 weeks ago the solicitor contacted all 17 beneficiaries of the will and said he needed to start paying out the money though so why would they say this if they have to wait until September and is there a way to know how much I will receive?

        I don't know the circumstances or the wording of the will, however pecuniary legacies might well be paid, and even the residuary beneficiaries might be paid.

        Doing this however could leave the executor liable personally if a successful claim is made under the Inheritance Act, and it is not uncommon for the prudent executor to delay payment for 6 months from obtaining the grant of probate. It was on that basis I suggested it might be September.

        Why not ask the solicitor when you are likely to obtain your legacy and at the same time ask "how much"?

          I haven't spoken to the solicitor personally and dont know if its appropriate to be phoning and asking when and how much I will be receiving, I have waited 18 months to get this far it's just getting very stressful now not knowing.
