  • Help with Form N215 and 'hello'

    Hello All, I am going through MCOL to reclaim money lent to someone. The web site mentions form N215 - if I send this, what is classed as appropriate accompaniments? The defendant is somewhat elusive and refuses to give me his address. I only have his previous address. Can I state this on /with the N215?

    Also, can I attach an attachment of earnings form or does this come later?

    Lastly, where do I advise the Court that he has been extremely unhelpful regarding giving me information and the fact that in 6 months he's contacted me once and not responded to my many attempts at contact?

    I have scoured the Internet, but nothing definitively states what can accompany form N215.

    That's because you don't accompany anything with an N215 form. It is a certificate of service to verify that you served separate particulars of claim (outside the MCOL system) on the defendant on a particular date and time and at what address.

    If you didn't tick the box when you went through the claim process on the MCOL system that you agreed to send separate particulars then you don't need the N215 form.

    All your other points about no contact from the defendant, to me, don't seem particularly relevant at this stage, that will all be discussed at the hearing if you want to raise an issue about the defendant's conduct but your primary claim will be the money borrowed and is now due and payable.
