My wife and I are in our 70's, live in the UK,married for ten years which has become intolerably toxic. We are exploring the best way to move forward.
I own the house, car and I have a number of pensions and some invested savings - all these were I owned before we met. She has no assets of any kind. Clearly we are both past the age of being able to work or earn any income.
We are exploring divorce but would be grateful to find answers to a number of questions. *
1) * If we divorce how many of my assets will be liquidated and given to her - my house, pensions. I clearly cannot work or re mortgage. What happens if she remarries???
2) * If we come to an amicable agreement, for example she finds a flat to rent and I agree to pay her a monthly amount, would the court accept that, or will they impose what they consider to be an acceptable amount.* Who decides the final financial agreement, the couple or the court.
3) * If we decide not to legally divorce or separate, and she finds a flat of her own, is there any form of legal contract to stop her returning to my house in the future without my agreement. Does she have a perpetual right to access.
