  • Cancelling PCP for unroad worthy Car

    Hi,*
    Last March I bought a new Jaguar from garage. I was informed the logbook would be posted out to me. After several months I still hadn't received it so I sent a reminder email. I sent a few more with no answer. This March (one year later) I still had not received it so went into dealership. I am unable to tax car as I do not have logbook and when I phoned DVLA they said they could not help me as I have moved house.
    As my car is not taxed the garage have given me a lower spec car and took my car to garage to store. My question is do I have valid grounds to return the car with no penalty from pcp. I am one year into a 4 year deal.*

    You really need to be looping un the finance company because they are the owner of the vehicle not the dealership - that's who your contract is with not the dealership.*

    If you dont get the finance company involved you run the risk of wrongful termination and being liable for the whole of the contract.*

    Not that I'm suggesting any wrongdoing in your part but I'm a bit surprised you've waited a whole year for the logbook without taking any action and reject the car. Most people would be on this within the first couple of months and because you've waited for so long, a court might consider you to have lost your right.

    i think you need to be writing to the finance company and explaining the situation. Give them a deadline to get that logbook otherwise you are rejecting the vehicle. If they cant the* I think there might be reasonable but whether you do that is your choice and risk.
