  • Unfinished roof but default notice for non payment

    Hi I had a new conservatory roof fitted in jan. Or should I say started in jan. The company I got the roof from received payment for it through a finance company before the roof was started* there are a lot of faults with it, after taking 2 months to complete it. I have told the finance company that I want it put right. It also leaks. The conservatory company said it has been finished although no one from the company has checked the roof* I was not given a guarantee either. I said until it is put right then I wont pay a penny. I keep getting letters from the finance company and now a default notice. What is my next step please.

    You've mentioned that you aren't going to pay them until the roof has been finished/repaired so I'm not sure what it is you are asking.

    In my view, poor choice refusing to pay them unless you are rejecting the conservatory completely as not fit for purpose or not of satisfactory quality and now you are at risk of getting a default on your credit file.

      First of all the finance contract is separate from the conservatory installation. You are therefore liable to pay. Go to the finance company and the conservatory company and start making complaints.* *Did you pay part of the cost on your credit card? If the amount was over a hundred pounds then you have protection under consumer credit legislation. write or email the finance company and the conservatory company with your complaint. Take as many clear photographs of the problem as possible. State clearly in the letter what you need doing and give a reasonable period for it to be done. Please bear in mind many fitters are either not being hired as they are self employed, or are on furlough.

      The company should be a member of one of the trade bodies such as The Glass and Glazing Federation.* These have independent dispute resolution mechanisms but in most cases you will need to have exhausted all the internal dispute mechanisms firstl.
