  • Do I own this land

    Hi I brought my house in 1997 and the end boundary to my garden is a fence, this fence is a replacement to a wall which fell over however the fence is on the far side of the foundation so the foundations to the wall are in my garden.* Do i own the land up to the fence?* as a developer has brought the property at the end of may garden and I have been told they are using the original wall foundations and I have no say in the matter.* thanks

    Can't tell where your boundary lies just from the position of a fence or a wall.
    It is possible that the boundary is marked by the fence, or the outer edge of the wall foundations or the wall itself or it may be the wall is dead on the boundary and is shared with your neighbour.

    In the first place you need to consult your deeds or land registry file to see if they give an exact position for the boundary. The Land Registry map will only be indicative.

    If you have no proof of where the boundary lies you might need to have them determined.

    By using the wall will you be losing much land? Determining the boundaries will not be cheap and might not be worth the expense, especially if it is decided the builder was right!

      You could try National Land Information Service (NLIS),
      Now I have use the Scottish site and looked at my site and the adjacent properties and boundries.
      there should be a facility to superimpose the current satellite image on the boundries, thereby seeing any imposition

      I have only used the Scottish site and only the free acess area , see what you can get from the site,
      I would advise staying away from Land surveyers, they charge like the Light Brigade, and there is nothing that you can't do with a 50 mtrs tape

      I have just had a look at the site and while it's changed since I last looked at it(5 or 6 years ago).they have a consumer section and you can buy site maps/plans etc
