  • Non fault accident no payout on financed car in someone else’s name- help!

    Hi , my son bought a car last year, first purchase, checked history nothing showed up, was a private sale this lady’s husband was selling it on her behalf as needed a bigger vehicle. Seemed genuine enough, we did a cash transfer and drove the car home.
    All was fine until 5 weeks later the car needed a new clutch as was semi auto, costing £1200 in addition to the £6500 paid for the car!
    Then last month someone hit my son in the rear as non fault accident, the car has been totalled. But we just found out there is finance on the car?! Cannot seem to locate the website re the history check, we’ve called the finance company (which my sons insurance company has giving him the details) to state this car was bought in good faith and to release the interest, which they won’t do!
    we’ve given the insurance company the details of the previous owner for the finance as they are still making payments each month! But now the insurance company are saying they’re in stalemate as they cannot release the value payment to my son for his totalled car without the finance company agreeing to release the interest.
    can anyone advise what and if there is anything else we can do. My sons currently in hire car from his ins company until he gets paid out? It we are worrying he won’t be given any payout for his car?!
