I just received a charge notice reminder for overstaying on a retail business park in London Lewisham only by one minute. The charge notice is for £100 as I have ignored their first letter. I actually have never received the first letter.
The parking company is HIGHVIEW PARKING and are warning that a landmark supreme court ruling of Parking Eye vs Beavis, it was established that PCN issued on private land is enforceable and these charges are deterrent for breach of contract.
Can someone please advice what response I should write to them as an appeal ?
I was looking on internet and I found this advice given to someone for Athena parking. Since this is not the same company I am not sure I could use the same argument just change from Athena to Highview Parking.
Can Athena show that the charge is fair and reasonable, and not punitive. Where is the option on site for the driver to pay to park for more than 1 1/2 hrs?
Can Athena show a full break down of the genuine pre estimate of loss following from any alleged breach of contract? Obviously business running costs do not apply.
Can Athena show , by proof of sight of the contract , that they have the authority from the land owner
