Hi, you will need to give us some details for us to be able to help.

Just give some of the key information and if we need any more details we can always come back with some questions.
If you would like a one-to-one expert consultation with me on your employment issue than I can be contacted by emailing admin@legalbeaglesgroup.com

I do not provide advice by PM although I may on occasion ask you to send me documents this way but any related advice will be provided back on your thread.

I do my best to provide good practical advice, however I do so without liability.
If you have any doubts then do please seek professional legal advice.

      Hello everyone

I'm looking for someone to help me.

I qualified as a Mortgage Adviser a while ago, and an opportunity come up to work with a company based in London. As it was a self employed position I had to sign up to use mortgage sourcing software. This was about 17th January 2019. This position didn't come to anything so I called the sourcing company on January 23rd 2019 to cancel my subscription. After a year, they sent a message to my secondary email address saying I owe over £200 and still rising. I have replied to their emails but have had no response from them. I can't understand why it would take them over a year to contact me.

I don't know what to do.

Please don't worry you have done fine. I have just deleted your duplicate thread to avoid confusion.

I do have a couple of questions:

Did you sign up to the software online? If so did you have to click a box confirming your acceptance of their terms and conditions.
By any chance did you read them or download a copy of them? What would be good to know is what termination clause they had in place?
I presume you cancelled any direct debit you had set up for payment which I presume was on monthly basis?
Did they give you any breakdown of the £200?
I presume there was nothing in your Spam of the primary email address?
How many emails have you send them without a response?

          Sorry for all the questions.

Yes. I did sign up online and I believe there was a tick box to accept terms and conditions.
No. I did not read them. Who does?
There was no direct debit set up.
5 emails have been sent with no response
I have attached a copy of T&C's and also last invoice sent

Thanks for the documents. I have had a quick scan of the T&C's document and it looks like under clause 13.1 you can terminate the agreement but this needs to be done by giving 3 months prior notice in writing. I understand from your post #3 that you only phoned in to cancel the agreement.

As a suggestion have you contacted the Accounts number on the invoice to query the situation with them?

Yes I did contact them by phone when I receved the first invoice after a year. That's when they said I had to give three months notice. My point is, if any business hasn't received a payment in a reasonable length of time, I think approx 3 months, surely they would think something is wrong and contact you in a different way. They have my address, a secondary email address and not leave it a year.

There could be a point to raise that their systems have a weakness for leaving it so long to chase non-payment. However their termination terms are clear and for them a contract period is 12 months again stated in the T&C's.

I suggest, since your emails have not had any response, you phone the number on the invoice and try to speak to someone about the situation and see if you can come to some agreement based on the fact that you did try to cancel, albeit by phone on 23 Jan 2019. If they do accept this as a termination of the agreement then be prepared that they will still require you to pay three months of fees for the contractual notice period - this would be a good result. However they may not accept this.

If you do get an agreement ensure that you take the name of the person you spoke to, note the date and time and that you get them to confirm by email.
