  • Notice of application for attachment of earnings order

    Hello,
I received a N55 notice of application for attachment of earnings order from Arrow Limited. It was dated 5th March 2020 and the date to respond has now passed.I left the UK nearly 7 years ago but this letter came to my parents old address and my dad opened it and posted on to me. It is for a sum of 7,500 and there is also the threat of imprisonment. This is literally the first communication I have heard from them but obviously I have been away from the UK for a long time. I am a bit confused about the whole thing to be honest but I guess the critical question is what will the next steps be as it is past the date of response (and likely would have been by the time my Dad even picked it up let alone sent it abroad). They have mentioned contacting my employer - again, I have not lived in the UK for a long time. Also, and I guess most importantly, were I to visit the UK would I be arrested and imprisoned?*

You must respond back to the Court ASAP telling them you live abroad. An Attachment of Earnings will not be possible unless of course you are still paid by a UK Company.

Thank you for the speedy response, hugely appreciated. I am not paid by a UK company. Is there any guidance for what I should say to them bar I am living abroad? What is my legal responsibility?

If you don't respond then technically a warrant could be issued for your arrest - they don't know you live abroad - as you would be in Contempt for not having filled in the form. I believe there is something on the form where you can inform them of your current circumstances, but as you live abroad this may not be possible. Do you know which Court it has come from as you could then contact them direct - see https://courttribunalfinder.service.gov.uk/courts/ for details

It has come from County Court Money Claims Centre in Salford, has a phone number listed so will give them a call. Doesn't say a particular court unless that is the one?

Sorry, one more thing - this was sent to my parent's old address - I was on the electoral roll in a different area, is this still ok for them to do this?!

Only one way to find out but they must say why they are doing it for you ie you are not able to do it yourself because you are out of jurisdiction.
