  • Just found out I'm being taken to court!

    I'm a frontline nurse in the NHS and this is literally the last thing I need right now. Finished a night shift to get home to a letter from a Litigation Friend to say that court proceedings have been started against me and my partner (and a letting agent who is the third defendant) regarding our house which we rented out until just before Christmas.**

    The tenant is claiming for personal injury for stress and anxiety as well as breech of contract (which she says is a private agreement she made with the letting agent which I knew nothing about).*

    So it has transpired that a letter before action as well as the Notice of Issue have been sent to the letting agent/their solicitor and not to me. The first correspondence and knowledge I have about this was recieved today from the litigation friend saying I have until 30th March to file a defence.*

    I have called the court (County Court Money Claims Centre) and they have told me I can file a N9 to ask for more time but to be honest, I don't have any Particulars of Claim so I have no idea what I am even defending. It relates to my partner too, which is just what we need!*

    I'm looking for any hand-holds available whilst navigating the court process!*

    1. Have you called the letting agent about this and what have they said?

    2. Ask them for a copy of the Particulars of Claim, if they don't have it you can get a copy from the Court. If legal proceedings have started, then there should be a claim number.

    3. Get to the bottom of this private agreement, is there any correspondence and if so you want to see a copies.

    4. Do you have a copy of the tenancy agreement for this individual? Did you sign it or did the letting agent on your behalf, either way you need to read/get a copy and check to see if there is a clause around giving notices.

    5. It would be helpful to see the letter sent from the litigation friend, personal info redacted.
