Hi, I understand this question has been asked loads of times but I haven't been able to find a definitive answer.
I have just VT'd my car with vw finance after paying the 50%. When I got the car in 2016 the only paperwork I received from Lookers stated on it that for any excess milage I had to pay 0p per mile. When I got the car excess milage wasn't discussed although I was aware of it in theory and chose the miles that I thought I would be doing, my circumstances changed about 12 months into my contract where i would be traveling a lot more than the miles i'd chose. So I looked at the paperwork to see if there was a way of changing the milage mid contract and this is when I noticed the 0p per mile on the paperwork that I believed was my agreement so I just left it happy with that.*Yesterday I received my confirmation letter saying that my contract was terminated but also on the letter it said I would have to pay 10.8p per mile, I am about 20k above the milage figure I should be so it would be a substantial amount. I phoned Audi finance and told them about my paperwork and was told that they had the agreement and it was 10.8p per mile, I realised with what they were describing that what I thought was the agreement was just something Lookers had gave me and they had never gave me a copy of my credit agreement. So my question is am I liable to pay this excess milage? do I have a case with the wrong paperwork (which was signed by myself and salesman)? and also as Ive had a letter saying my contract is now terminated does that not mean that Im no longer tied into the terms of it anyway?
