our neighbour has just submitted a planning application for a 2 storey extension that will clearly involve scaffolding. As the extension goes upto the boundary the scaffolding will therefore need to be erected on our drive & restrict our ability to turn cars around amongst other things. W will therefore look to object on these grounds but the only unknown is their rights. They have acces rights over our land for accessing their property which is documented but this also says the area should be kept clear. All of the information I have seen appears to indicate it should be rejected as our approval permission would be required is this correct & if they went ahead anyway what are our rights? Our property is also on an major A road so reversing out isn’t a safe option either.
