Hi all,
I'm new to this and am trying to swat up as much as possible before I take things further with PSA Finance...
I recently voluntarily terminated my contract with PSA finance one month before it was up completely, 47 months out of 48. I cleaned the car to showroom quality and dropped it off with Manheim. The guy looked round the car and took pictures of any problems and told me I would receive a condition report, which I never did.
*
After a week or so I got a letter off PSA saying I owed them £1504.54 for excess mileage and £360 for wear and tear. (details of the wear and tear were still not explained to me by this point).
Here's the confusing part, when I 'bought' the car I said i'd be doing 6000 miles. Shortly afterwards I changed jobs and needed to drive more so I phoned PSA saying I'd be doing 10,000 miles a year. Now i'm fairly certain that the guy on the phone said my monthly payments wouldn't go up, so I did nothing. I'm sure I received no letters from PSA about this. If I did then i'd have sent them back. Its hard to remember as it was 3 years ago but i'm fairly on the ball and wouldn't have ignored any paperwork for this.*
So, I called them up asking what the situation was. They said that because they never received any paperwork off me saying it was okay for them to up my monthly payments to cover the extra mileage that their excess mileage charge still stands.*
I asked them about the damage to the vehicle and they sent me my condition report the next day. Some of the things on the report are problems that were present on the car when I bought it. Cigarette burns/ scratches etc, so why should I have to pay for them?!
They told me they have started a case for dispute which could take up to 8 weeks but any funds that I owe them, excess mileage & wear and tear, should still be paid and then if it comes back in my favour then they will refund me. I have cancelled the direct debit and I expect to receive a steady stream of threats of court cases and bailiffs...*
Do I have a leg to stand on or do I just have to bend over?
Any help would be greatly appreciated.
