Hi LegalBeagles. I live on a housing estate that includes an area of small shared ground. We are charged half yearly (circa £100) for the maintenance of the common ground. The company invoiced in December for the forthcoming 6 month period of maintenance (Jan 20 - June 20) with a payment due date of 01 Jan 2020. Admittedly I forgot to pay this invoice, however yesterday received a notice from a debt collection agency who would now be recovering the debt to the sum of £400!
Is this a debt that can be passed onto an agency as the service hasn’t yet been provided by the maintenance company? Is this even classed as a debt? I intend to pay the half yearly fee tomorrow once they are open again but what about the additional £300 in fees from the debt agency?
