  • Claim form from Phoenix Parking Solution/QDR Solicitors

    Hi*
I was wondering if anyone here can help.
I got a PCN from*Phoenix Parking Solution for originally £60 and 14 days later £100, about 5 months ago. I ignored the first letters from Phoenix Parking Solution, and began to get more letters from ZZPS and later QDR Solicitors. At first it was all threats, until today, when i received a Claim Form from the County Court Business Centre in Northampton which is asking me to pay £235. Which is broken down by, £100 fine, £60 admin, £25 court fee and £50 legal representative cost.

The question i had is, when i now go on the Phoenix Parking Solution*website to pay the fine, it is telling me to only pay £100. If i now pay the £100 fine via the website will this mean that i have settled the fine and therefore no CCJ will be issued or will it only be settled if i pay via QDR/Claim form for the full amount of £235?

I am looking to get a mortgage this year and i don't want to risk having a CCJ which will really jeopardise my credit profile. Hence i want to pay it before it goes onto my profile, and i wouldn't want to pay £100 and still get a CCJ.* Any advice will be very much appreciated*
    Many thanks*

You will only get a CCJ recorded against you IF it gets to court and IF you lose and IF you don't pay within a month.

So wait 5 days then acknowledge the claim online using the details and password on the form.* Nothing in the defence.* This gives you 33 days form the date of issue to get the defence to the court.

Post up the redacted PCN but leave dates.**

      Thanks Ostell, appreciate your help
I will try to go down the appeal route yet it seems like it requires time (which i don't have in this moment of my life). In the case that this is not possible due to my current personal circumstance to appeal,*If i pay the £100 fine via the website will this mean that i have settled the fine and therefore no further proceedings*will be issued or will it only be settled if i pay via QDR/Claim form for the full amount of £235?

I doubt if they will accept £100 as they have already spent more money on this.* You could offer them say £150 to settle.* They lose more thanthis if it does go to court.

The £60 is an abuse of process and as the registered keeper then you are only liable for the original PCN + court cost.

You are not appealing, you are in the court process and have to follow the timings.* Failure to follow the process WILL get you a CCJ by default.
