Hello, looking for some advice if possible please....I purchases a car from a sole trader trading under a “business” name (not a ltd company). I part exchanged my car and payed via bank transfer of £1500 (total value of £5700). I drove around 130 miles back from picking the car up and everything seemed fine. Didn’t get much opportunity to drive the car after due to holiday but when I did get a chance to drive the car again I was driving the car home from work (20 days after purchase) it broke down. I took it to a local garage who unfortunately took 2 weeks to look at it due to being busy, they diagnosed some pretty serious issues. They’ve advised that the issues are not worth fixing and suggested I return the car as it’s not road worthy. They also advised there appears to be evidence of a previous repair attempt and will give me their diagnosis in writing They believe the issues existed before I bought the car. I contacted the trader and advised the problems, I advised I want to return the car for a full refund and my part ex back or for him to fix the issues under the consumer rights act. I sent these via email and text, he has read receipts on so I know he viewed the text. He called me back the next day, asked for more info and a copy of the garage report and their contact number. He advised he will look into it but suggested he doesn’t believe the garage as in his words I wouldn’t have been able to drive home with the issues they describe. I just wanted some advice on where I stand? If he doesn’t cooperate I understand *will have to take him to small claims court. It has been 35 days since I bought the car and covered fewer than 200 miles in the car. I offered to pay my self to transport the car back to him and to transport my part ex back to me just to save on hassle. I just need some advice and reassurance of what my rights are Or what actions to take. Thanks.
