Hello,
I am the freeholder and leaseholder has breached the lease ( Tribunal finding ) The breach is taking down the front wall to access front to park a vehicle.( Lease says use of the Garden front and back and they only have foot access to the property at present) At first plans were in place to exchange an amount of money for access via the wall and amend the lease. This later failed whereby the leaseholders retracted the offer which they are now saying the covenant is restrictive and I have been unreasonable. I believe the wall is retained property as it is not in the lease. I am right on thinking this ? Adice would be appreciated. Thanks
