  • Splitting up from partner, what rights do I have?

    Hi all, me and my partner have been together for 15years but not married and unfortunately we are separating however I'm unsure if I'm entitled to anything.
    Our mortgage is in their name due to my poorer credit rating so I had to sign a tenant form.
    Since buying the house we have built an extension with the value increasing approx 40k.
    I have been transferring my half of all the bills every month into her bank account.
    Do I have any right to ask for half of the increase in property value or will I get laughed out in court if it goes that far?

    I am sorry for your circumstances.* As you are not a joint owner you will not at first instance be entitled to any share of the property.* However, you mention something regarding ' a tenant form'* was this to do with a 'tenant in common ' .* If so this could mean that you will own a percentage of the value of the property.* Also, you will have a beneficial interest in the property if you can prove that you have contributed in any way towards maintaining the property. My suggestion would be to consult a solicitor.*

      Hi, thank you for replying, at the moment I can't find the document I signed so I'm unsure but my partner was told I had to sign it or they wouldn't get the mortgage approved.
      Just to add we both were renting the property for 5 years before my partner got the mortgage and in that time we have renovated the whole house including building an extension which was all paid 50/50.
