  • Recieved county court business centre claim from Lowell

    If some one can just offer a little advice it would be very much appreciated.

    So I received the old county court business centre claim form from Lowell
    Ive already followed all your steps as advised on here so that's all good, I was convinced this debt was statue barred (old credit card bill) the debt was removed from my credit file in July 2019.
    Suddenly Lowell put a default notice on my credit file dated June 2016 to present. I had a few letters from Lowell about the debt but just ignored them as I thought it was impossible for them to chase it as original creditors debt had been removed from my credit file.

    I wrote to Lowell with a template letter confirming I felt I did not owe them the debt as I was positive it was statute barred and it mentioned the limitation act, I asked for a copy of the original credit agreement etc but the only reply I had was them stating the account was defaulted in June 2016 and the debt is not statue barred as the 6 years had not expired since this date, the debt apparently passed on to Lowell in December 2017.

    The one thing that was bothering me is surely if I defaulted the original debt in 2016 it would still be on my credit file from the original lender?

    Defence has to be put in Sunday 9th, im just doubting my self now do I just set up a payment plan or fight it I canT afford a ccj*

    I have since sent the*
    CCA REQUEST to the CLAIMANT and*CPR request to the CLAIMANT'S SOLICITORS no responce*
