  • 1st ever parking ticket - HIGHVIEW PARKING

    Good evening all,

    I have just come cross Legalbeagles and noticed there are a good number helpful users on here with a good level of understanding parking fines. This is the keepers first ever parking fine so would be grateful for any advice as to whether there is a chance in getting it overturned. Hopes are thin under the circumstances.

    The keeper overstayed the maximum time limit by an hour and 6 minutes at the following retail park which is free to park.*https://completelyretail.co.uk/schem...l-Park-Catford

    The keeper is moving into their first home so a number of different shops were visited in the retail park within that time with evidence of 3 retail receipts equally to around £700.

    Is there any room for appeal or is it safe to say that the keeper will need to shell out the fine outlined in the attached charge notice?

      First edit the post so that the identity of the driver cannot be inferred. Use "the driver ......." etc. The driver at the time parked, the keeper is responding

      Dear Sirs,

      I have just received your Notice to Keeper xxxxx for vehicle VRM xxxx

      You have failed to comply with the requirements of Schedule 4 of The Protection Of Freedoms Act 2012 namely, but not limited to, failing to give notice of keeper liability as prescribed by section 9 (2) (f) of the Act. You cannot, therefore, transfer liability for the alleged charge from the driver at the time to me, the keeper.

      There is no legal requirement to name the driver at the time and I will not be doing so.

      I do not expect to hear from you again, or your debt collectors, except to confirm that no further action will be taken on this matter and my personal details have been removed from your records.

      First class mail with free certificate of posting from a post office.

      You should get a POPLA code when they reject your appeal but when you appeal to POPLA with all the other POFA fails then you should be successful


      In parallel go round the shops that were used by the driver and complain about spending money there then being hit by a parking charge.* It's not a fine.
