    I have received a letter from Mortimer Clarke about a debt i can't even remember having.* They are telling me they are going to send someone to my house from Resolvecall. Is there a way i can stop this from happening.............................. Many thanks*

    Wouldn't worry about ResolveCall turning up. If they do call answer the door and tell them to do one explaining you will give them 30 seconds to vacate your property before you have them done for trespass.

      I think the debt in question is over 13 year old but thought it was all sorted back then

        Have just received a visit from Resolvecall who wouldn't take no for an answer and still dropped a note through the door. This debt is years old as i couldn't even remember it until i received a letter from Mortimer Clarke recently. Is there anything i can do to stop them coming again . Any advice would be much appreciated .

          how much are they pursuing you for? is it a few hundred pounds or thousands

              £10k wowers, thats a fair whack. Do mortimer clarke give you any details about the debt at all?

              First things first, you do not have to accept visits to your home, you can tell them to stop and t hey must stop. There is a case called Harrison v Link ( its in my signature) and it shows clearly that harassing someone can have seriously bad consequences for the creditor if they keep on. Make sure you keep records of any letters you send or any calls you make.

              As far as the underlying debt goes, have they taken it to Court yet? and do you know what the debt relates to?

                They debt was for a car. They car was actually repossessed to pay off the debt or so i was led to believe.* I was in a bad place when this was happening. If i remember rightly the company folded not long after this. There is nothing showing on my credit report about this either maybe because it was so long ago i can't remember whether it went to court either*

                  Ok well thats sadly not a lot to go on. The fact it isnt on your credit report doesnt mean its statute barred sadly, we would need to do some more digging on that point before we could say for sure its barred by limitation.

                      It would be a case of building a case im afraid, if i were dealing with this case the first thing id be asking mortimer clarke for is a copy of the contract, a complete statement of account and any other supporting documents they have in support of their case. Id also be asking for details of any litigation that may have been pursued, and if there was a judgment in place then a copy of the judgment too.

                      That would give me the info i would need to progress the matter

                          Costs? Possibly yes, if you are instructing a lawyer then you may incur some costs, but at the end of the day often a small outlay can bring a case to an end quickly, and can save you money in the long run
