Wondered if someone could help me out. Basically I received a judgement letter today from an online court in relation to some mystery shopping work I did last year (I’ll go into the details later) and I was very shocked to receive this. I have not received any claim form from the court which was allegedly issued in November last year. I called the court today and the lady didn’t really want to help me. She said there wasn’t a lot she could do.*
I want to know if there is any chance to get this judgement cancelled or if I should just pay it and be done.*
So this is what happened...
I do lots of work for mystery shopping companies and I was approached by one to do an assignment where I sign up to a gambling site, wager some money and then complain to try and get bonuses applied just to test customer service levels.*
I could deposit up to £50 and would be paid £25 plus expenses.*
So I deposited the money, played for a bit. Ended up winning £500, so I was in a bit of a position. I carried out the task as described to test the level of customer service. Submitted all of my reports. They were approved and then the money was still there. I was never told that I couldn’t take it. So I withdrew it, 6 weeks later I was contacted by the company asking for the money back, stating that if said in the brief that any winnings would be removed from the account. I challenged this and said it was a tiny line in a large brief and nobody ever told me I couldn’t take winnings (they didn’t) the chap running the assignment even told me to ignore the brief and follow what he sent me in an email.*
My argument was that nobody told me directly I couldn’t keep the money. I did the assignment and it was all approved, then I took the money. They contacted me so long after saying I owed them £520 and that I needed to pay them back. I said that I didn’t agree and that I had spent the money so was unable to pay them back. We had a few emails going back and forth and the last one I got simply said your comments are noted.*
I then received nothing until the judgement in the post.*
Having spoken to the court I seeming have the option to appeal but it will cost me £255. Is this correct? if I do this based on the information would I likely win?*
I have spoken to the company again today on the phone. Offered them half the money even though I feel that I am not in the wrong. Then I offered them the money in £130 instalments over 4 months. They refused both offers.*
Obviously I don’t want a CCJ against my name so I need to do something but I’m at a loss as to what I do now.*
It says the due date is 31st January. If I pay before the end of Feb can I get it removed? Is that correct because that’s how I’ve read it?*
Should I pay it at all? The company are claiming they have had to pay the gambling firm back the money I took out l, should I ask them to prove this?*
