  • I am going to defend a claim, when do i send my evidence?

    Hello Everyone,

    I've received the claim form in the post. Due to Christmas i did not have much time to defend so i filed the ackn. of service.

    I now need to defend the claim. My defence is very simple.I rented a garage from them and now the claimant is claiming that i did not terminate a contract and now wants money for the storage fees, however i have a proof of postage and a copy of the letter terminating. This has been provided to them before but they are not willing to budge.

    Do i send this to them with my defence as they have not sent any evidence to me yet. I've done the Small Claims Court before and i have a memory of providing all the documents a few weeks before the hearing (if it gets that far).

    You’ll be directed by the court to provide a trial bundle of evidence, but that won’t be for some time.
    you should now explain in your defence why you reject the claim.
