  • Statute Barred but have just received a CCJ. Help Please

    A debt of £900 in 2007. I heard nothing till around 2 years ago. I followed advice and requested proof of debt paperwork. For the next 2 years I have received intermittent letters to tell me they were still searching for the proof. I had no other dealings with them. I never admitted liability in fact I told them I was not admitting liability. Today out of the blue I received 'Judgement for Claimant (in Default) letter. The Claimant is Mortimer Clarke Solicitors, who must have bought the debt off Cabot. However of doing some address checking it seems Mortimer Clarke and Cabot are the same people or at least connected. I knew nothing of being taken to court for a CCJ until this dropped on my doorstep. How is even possible? It's been 13 years and I have not admitted to the debt, nor were they able to supply proof, to me anyway. Is the Judgement letter real? I went on my clearscore account and it shows my 2 closed accounts, one of which is this 13 year old debt. It is saying it is still closed. There is nothing on my report suggesting any CCJ's and according to my report I'm ticking along nicely. If I call this Mortimer Clarke Solicitors I'm afraid it could re-open the debt. But it seems the court has overlooked the Statute barred and seen in favour of these parasites. The letter from the (Real or Not?) Court is even telling me how much a month I have to pay back. £50 a month. At the bottom it says If I ignore this letter my good may be removed and sold.

    I just don't really know what I should do for the best at this point. Is there someone out there that has been through this and could give me some advice. Pleeeeeese.

    Mortimer Clarke act for Cabot - so Cabot will be the judgment holders and owners of the debt.

    Did you not receive the claim form ? Would have been around second week December ish ?
    Is the letter from the court like this ?

      Yes the letter from the court looks like that. I haven't received anything till this dropped in today.
