  • Faulty Car on PCP Finance

I have a Audi A3 2016 S-Line on PCP. I have had the car from new and has been well looked after. It is currently on 36,000 miles. From around 12,000 miles it began to have problems occur such as, error messages on dash, faulty sensors etc. More recently it hasn’t been starting and been cutting out!! I have been back and fore the dealership for repairs around 12 times. This takes me 45minutes there and 45 minutes home. Sometimes going down twice in one day to return courtesy cars.*

I submitted a complaint with Audi Finance who came to a conclusion that the car isn’t faulty as when they plug the computer diagnostic software into the car no faults or errors show. Audi UK said they have no responsibility with the car as the agreement is with the finance company. So no one is taking accountability for the vehicle.*

    list of faults are:
    *
    1. Not started numerous times
    2. Engine cut outs
    3. Drive system faults error messages
    4. faulty sensors (dealership did not repair or replace fuel sensor as they said it was a intermittent fault where the car doesn’t start. It needed to be more regular)
    5. faulty battery meaning car wasn’t starting and was dying when idle over night.*
    6. heated wing mirrors breaking twice in one year*
    7. creaking suspension*
    8. electronic handbrake didn’t apply once before*
    9. all of the above faults are on top of random warning lights such as Drive System Fault, Tyre Pressure System fault etc etc.
I am in a position to start a voluntary termination of the contract. However, this means I have been paying full price for a faulty car. Am I in the right for any compensation or refunds? E.g. my deposit? I am also over the mileage of my PCP agreement (I didn’t worry about the mileage as I was planning to pay off and keep the car). They want to charge me £700 for this. Considering what has been going on with my car, I find this very unfair that they won’t pay out anything to me, yet I HAVE to pay them fees such as this.

Financial Ombudsman said the complaint could take 6 months if I started it with them. I need out of this car ASAP as obviously it isn’t starting sometimes and it very disruptive to work and personal life. **

Any help or advice on this?!
