Hi can you please help over a year ago I received a parking Charge Notice to my address for a car that does not belong to me on closer inspection I could see it was not my name very similar the middle two letters were different I didnt have my glasses on when I opened it I returned the letter to sender sometime after another letter arrived and I returned that and I heard no more unfortunately I split with my wife and moved to Spain I have since returned to England and checked my credit report before applying for a mortgage only to find a ccj in the name of the individual who owns the car I have contacted the court to have the judgment set aside because its not in my name they are unable to do this they told me to contact the credit reference Agency but they have been no help I have contacted the fraud agencies and got a crime no any ideas mick53

You first need to contact the judgment holder and tell them that a judgment has been entered in default against you wrongly for what appears to be a parking ticket for a car you have never owned. Explain to them that the name is very similar however there appears to have been a tracing error re middle name. They will say there's nothing they can do, so ask them to send copies of the documents from the claim including the parking ticket their claim is based on. *You can then email both them and the original parking company *asking for copies of all your data that you are entitled to pursuant to the data protection act. *That should get you enough info to challenge them and trust online ( who look after the judgment register ) to remove the ccj from your file and attach it to whoever's file it should be on.*
If you ever receive a similar claim for something like this then deal with it at the time. RTS without any explanation just looks like trying to avoid it and is generally ignored.*
