    Hi I'm a new member and wanted to see if anyone has had experience with Voluntary Terminating with Startline motor Finance and IT-Fleet?

    I paid over the 50% mark and requested my VT in October 2019, I cancelled my Direct Debit for the Nov 2019 payment! Startline haven't been the best and after numerous emails trying to get the car collected and I even offered to drop the car off myself to get it closed off quickly I received an email on 10th Dec 2019 advising that they don't have an agreement with Manheim auctions for cars to be dropped off but if I wanted ā€˜'to try'' dropping it off myself I can but I may be turned away they then advised IT-Fleet could collect free of charge and they would pass on my details for them to arrange collection of the vehicle - I finally received an email from IT-Fleet this morning (17th Dec 2019) advising they could collect the car this Thurs 19th Dec. As I have cancelled the Direct debit Startline have been texting to say my account is in arrears and when I challenged this due to VT being accepted in october they say that payments still due until car is recovered! Is this correct? I was under the impression that once the VT has been accepted then I don't need to pay anything further? I'm now worried that Nov and Dec have now not been paid and a default will be logged on my file! Can Startline do this or is there anything in the CCA that I can write to them with if that happens? Thanks for any help! It's appreciated

    Short answer is no they can't force you to continue paying, and because you've already reached the 50% mark, you have no further obligation to make any more instalments.

    If they do threaten to put something on your credit file that is very much an easy claim for breach of data protection and negligence against Startline. Or you could make a formal complaint to them and then through to the Financial Ombudsman and seek compensation due to the adverse entry and breach of duty. Do be aware that the FOS will look at what's fair and reasonable and any redress through them might not be as great as going through the court system, especially with regards to this type of issue.

        There is a slightly longer response to this question in my VT guide which you can find on the link below, if you haven';t seen it already. It's under the FAQ section on page 16.

        Might be worth a read and get yourself familiarised with the process and what to expect because the purpose of the guide was to allow people to manage the process on their own instead of me having to repeat myself again!

          Hi Rob

          I've just had the following reply from Startline with regards to my cancelled DD which has meant I have missed 2 payments since the VT was accepted!

          ā€˜'As you have confirmed your option to VT was accepted, although you remain liable for any sums due and any arrears, which subsequently have fallen due since this point. This is detailed within the terms and conditions of your hire purchase agreement- refer to point 11.''

          Am I liable to pay under the CCA? Is there anything I can reply back to them with as I'm worried they are going to log a default against my file

            Hi! Not been on here for a while so apologies if this question has already been addressed elsewhere. I have a situation where Startline have registered a default against me on my credit file for not paying the 3 payments before they picked up the car from me. I VT'd but they didn't collect for considerable time. I see you mention a legal recourse for me, but can you explain it to me?
