  • Suing the local council for devaluing property

    Lambeth Council may give permission for a playground to be established on a piece of land that is 40 feet square in the middle of residential gardens along several boundary lines and 7.5 metres from my kitchen bifold doors. I have been told by 5 estate agents that if permission is granted I would have great difficultly selling my property, if at all.

    Should I let the council know that I intend to sue? I am meeting them tomorrow with my local MP.

    You can let the council know how you feel and what your intentions are.
    However I doubt it will worry them as there is no direct legal right to compensation for any financial loss caused by any particular designation of land under current Town and Country Planning laws.

    Possibly you might be able to issue a blight notice, but I suspect the counter argument will be the creation of a playground enhances the value of your home in the eyes of prospective purchasers with a young family.
