Hi all, I am seeking a bit of advice, so here goes. Several months ago my home was broken into whilst I was out, the burgalar stole quite a lot of jewellery, I reported it all to the police officers of whom attended at the the time and I filed a claim with my insurance company who appointed a team of loss adjusters (of whom came to my home for a chat and further details...however they absolutely interigated me and recorded the full interview). I was then faced with the insurance company wriggling and trying every way possible to not pay out for my loss. The insurance company wriggled and caused me a lot of stress and upset which I believe had a huge effect on my family life and most certainly my health as I was diagnosed with a serious illness during this case. It came apartment to me whilst I was in hospital that my health was the most important factor and I wrote to the insurance bacicly saying drop the claim as its causing me too much stress and health issues, the insurance happily ended the claim! and sent me a email showing their cost of the claim ( eg loss adjuster cost £3100 etc ) Please note the insurance did not pay me out anything. Now long story short and I will not go into detail, one of the stolen items was seen advertised so I went to the seller and took with me proof of ownership etc and took the item back (please note the seller was not the thief and he genuinely did Know the item was stolen he also fully understood situation). I then phoned the police and told them I had recovered the item and that it was no longer stolen. My main concern is that the insurance company are going to be notified by the police, stolen item national database etc and they may want the recovered item as they may hold a financial interest in the item because case cost them £3100 in loss ajuster costs.
My policy the the insurance company has now ended and I have got insurance cover from another company.
I understand if the insurance would have paid me out for the item and the item was later recovered then it would rightfully belong to the insurance company.
MY QUESTION IS... Is the item I have recovered rightfully mine as the insurance did not pay me out?
