  • CCJ and charging order issues with council

    Is it legal for a council to place a CCJ on my name and property when I have a payment agreement in place which is not due to be reviewed until August 2020 and I've been paying the agreed amount each month. They contacted me in January this year to inform me that they are going to put a charging order on my property based on the fact that I have equity now. I explained that the property was purchased with a gifted deposit from my mother in law and the home is not solely owned by myself and as the debt is nothing to do with my husband how could this be done. I was then told that I would receive further information from the court, this was never received. My credit file then alerted me that a CCJ was placed on my name in October and I still have no further details, this has prevented us from remortgaging and will have a detrimental effect on our families finances. Is this lawful?
