  • Gladstones parking court notice

    My son received a parking notice from CPM last December 2018 a PCN , he was dropping his nan off at her churchill retirement apartment , was only 15-20 mins as he escorted her as she is not very able and needs assistance , we then received the notice from CPM , we disputed the claim in the correct time period , but they sent a letter saying the dispute was outside the time limit and referred it to Gladstones , we followed all the advice posted got a LBC , sent them the letter template disputing the claim with the request for information and we are now at the last correspondence looks like the letter before court action , can some one please advise what the next steps are please .
    all docs in last pack attached , the photos are of very poor quality and the picture i presume showing where the signs are are from an aerial shot from google earth when the building was being built so the car park is not present .

    Looking at other parking threads and trying to get something to respond to Gladstones - some threads state if they do not have admission of the driver at the time of offence and it is on private land they can not pursue the owner , they need to prove who was driving is this correct , the car has several named drivers on the insurance so it could have been anyone of them

      Have a look at the Jopson v Homeguard case. The judge conlcluded that loading was not parking.

        Thanks that really is the relevant point , the time stamp on the photos is 10 minutes the car was not parked in a space or designated parking area , the time was to assist my mum who needs help to get up to her flat and make sure she is safe not an unreasonable request for an owner - ( I think ? )

        If I use this as a point to contest this response how would I reply to the letter from Gladstone’s , not sure if you can see their reply .

        Looking for some assistance - really appreciate your time and assistance.


        So that i can make sure my response is correct - i received after my request for info from the standard template a reply to i think dispute the charge --

        It is a reply form from the dispute resolution i think - my worry is it is back to Gladstones which i just do not trust ,

        the form has the option ......


        Section 1
        4 boxes -A/ pay - B/part pay - C/ dont know - D/ i dispute the dept - then it has a section to explain why , is this where i explain what happened as dropping mum off then assisting - car positioned in grounds not in an allocated space ( not use the word parked ? ) then reference the Jopson v Homgeuard

        Section 2
        - E/ i will pay what i owe , F/ i will pay but need time

        Section 3
        - G/ getting some advice -

        Section 4
        t H/ i have enclosed documents - (for time to pay ) I/ i need more documents -

        what do i need more from them - interestingly the examples are of a written contract for the allocation of debt , a full statement of account ,and a copy of the notice of assignment of debt and others

        what would you advise
