I have a consumer problem. I bought a reconditioned gearbox from a gearbox specialist for my classic car. After fitting it and running a bit (it's a low mileage car) I discovered that the gearbox was leaking oil onto the clutch. This can only have happened if the g'box was faulty when delivered - leaks are never caused by the car being used. I asked the supplier to do something about it, and he absolutely and categorically refused to have anything to do with me.
Being a low mileage classic car, it took a while for the leak to manifest itself in a slipping clutch. The car covered 650 miles over 2 years before the fault became so bad that the car was undriveable. I therefore had to have the g'box repaired by a third party, who declared the leak was due to faulty workmanship and broken parts used in the original recoditioning. Again I asked the original supplier to respond, but again he has categorically refused to even talk with me.
Help - what can I do? Some advice suggests that I could make a small claims case under common law, arguing that the g'box was not fit for purpose when supplied (which is unquestionably true). Some say I could not progress this under consumer rights. Further, that use of legal channels (ie a lawyer) would leave me seriously out of pocket. As it is, I have had to pay about £1k to have the g'box repaired by another party and buying a new clutch. Unless I had the g'box repaired, the car would be a useless heap of scrap! So I was caught between a rock and a hard place. The original reconditioned g'box cost just under £900.
Any advice or guidance would be gratefully received!
