  • Mis sold holiday apartment

Hello, I booked a 2-night stay in an apartment in Edinburgh via Booking.com

I deliberately chose an apartment in a quiet residential street, as I’m a light sleeper and my husband had asthma, however we were sent to an apartment some 400m away in the intersection of a 4-lane A road with 24/7 truck noise & fumes as it was on the first floor facing the highway. It was hellish and we left early the next morning after a sleepless night

I have complained to Amex, the apartment provider and to Booking.com but none will refund the money

the provider has since added copy in the listing stating that some apartments (2 of the 3) are at a different location. This information was not there when I booked. It’s not on any of my booking information

I believe this was breach of contract / deceptively sold

am I right and what can I do?

    Thanks in advance
