  • Moneyshop scheme / ccj help

    Hello

    I had a loan from Moneyshop in 2012 that got sold to BW, who registered a CCJ in 2017. I didnt find out about the CCJ due to moving houses but when I did, I paid off the CCJ in full.

    With this news about Moneyshop scheme of arrangement, my loan was likely irresponsible lending / unaffordable ( I have received their link for the new redressal scheme and submitted the claim).

    My question is, can I get the CCJ removed from my credit record, in light of the original loan being marked as irresponsible lending / unaffordable under the scheme?

    No. You'd have to apply to set aside the judgment and have good reason why you hadn't defended at the time, or applied promptly to set it aside when you found out about a default judgment ( as opposed to paying it off ).

    You could try and write to bw legal asking asking for their consent to set it aside ( who was the actual claimant / who is the judgment holder ?)

      The judgement holder is bwlegal..

      If a loan is deemed irresponsible lending by the FOS, then isnt the lender required to delet all negative information?

        Not CCJs I'm afraid.

        BW legal usually act for a lender/debt purchaser.

        You could see what comes of your complaint and then try applying to the court to set aside. The CCJ will stay on your credit file until 2023( 6 years). Have you got any of the paperwork from the claim ? or did you just ring up and pay when you discovered it ?

          I received usual collection letters initially, but coincidentally when I moved residence, the CCJ process was initiated. As a result, i received no paperwork whatsoever about the CCJ being started or executed etc, nothing on email either. I found out after i looked at my credit report and then paid up.

          I tried to ask bw to set aside in light of above, but they refused... perhaps I shuld go to FOS? or ask BW again since the new scheme has been launched? or..?

              I'm afraid the redress scheme is separate from the CCJ. Maybe wait until you hear back on that side of things, and then, if the redress scheme deems your agreement was unfair etc you can use that as a reason to apply to set aside and remove the Judgment.
