  • Nottingham City Council Parking Fine ( Residential Area ) HELP PLEASE!!!!

    Should have i of just paid this and not been so stubborn?... Or do i have reasonable grounds to carry on contesting?

    Around 2 months ago i was working on a property ( Painting internally) which is located in city of Nottingham, To unload and load my tools i briefly parked in the residential parking then found alternative parking. on completion of the job i loaded my tools back into the car, went back into the house to get the final bit of kit, my colleague followed me in a few seconds later and advised me a parking warden was outside ( he had parked next to me in the residential parking also without a permit ) but was told he was told he OK because he had a bottle of water in his hand and it was classed as loading/unloading. I came outside to load the final bit of equipment into my car to see her putting a ticket on after observing for two minutes. She acknowledged the equipment i had but refused to retract the ticket. i took a picture of my boot open with the warden still in view as evidence of my actions with the relevant time frame.

    I have contested this with the council but they refuse to cancel the fine and have now increased this from £35 to £105 with the threat of court action.

    I have been in contact with the council via email and our conversations have been dated and recorded.

    I also had 3 other witnesses who saw what happened and what was said between the warden and I, including my colleague with the bottle water for 'delivery'. They are all prepared to make a statement.

    the feeling of separate rules applied here comes to mind.


    Any advice here would be gratefully appreciated or any further information you would like me to provide.

    Did you receive a Notice to Owner?

    Did you make representaions to the council?

    Did they send you a Norice of Rejection?

      Yes to all 3 of those , I’ve also now received a charge notice.

        The Notice of Rejection would also have included details of how to appeal to adjudication. Did you do that? If not, the only option remaining is to pay the £105. If you don't you will be sent an Order for Recovery (addtional £8) and then the next thing you know will be bailiffs clamping your car and demanding upwards of £400.

              What witness statement? If you are talking about people who were witnesses at the time of contravention, since it seems you did not appeal to adjudication, they are of no use now. That boat has sailed. Meanwhile the enforcement process will trundle on and very soon bailiffs will be involved unless you pay the £105.
