  • Ex not paying maintenance

Hi, my ex is refusing to pay any maintenance. We had previously agreed £300 p/m for 3 children. She’s stopped paying out of spite. She got made redundant in June but is lying, saying that she got no redundancy after 21 years at a government organisation and as she hasn’t worked since is saying she can not afford to pay. The children spend no nights at hers, just go round for dinner twice a week. We originally agreed a 50/50 split after the divorce but now they all live with me through choice. I’ve been told by a solicitor that Schedule 1 of The Children’s Act 1989 means I can take her to court and get an order making her pay. Can anybody confirm or help with this at all?

Any help greatly appreciated from a very frustrated dad

Have a look on the above link. This will explain all you need to know.

You have had an informal arrangement in the past but it now seems that you will need a formal court order if you want to force your e
x to pay regular child maintenance.
