  • Adverse Possession of a space?

    Hi, I have inherited recently an old house with a detached garage that is built in the sunken space under the garden terrace.
    The garage space has not been used as a garage for a long time, in fact someone has been living in the space, he even added a kind of door to close that area off.
    Now he is claiming Adverse Possession of the "garage" space.
    The garden is clearly not part of the claim, since other people from the house regularly use the garden.
    I checked with a surveyor who refers to the garage as a Space in the estate, and he doesn't think it is qualifies as a separate land.
    My question is: does the law on adverse possession cover such a space? Which can not be called a 'land'.

    As always in these situations can you give us more info please.
    Is this a registered property?
    How long has he been squatting in the garage ?
    Has he made application to be registered as proprietor in place of the existing registered proprietor?

    have the council 1) Given approval for change of use from garage to residential?
    2) charged him council tax?


    Rather than applying for registration as proprietor your squatter's better plan of action (for him not you!) might be to claim prescriptive easement i.e. the right to use the property.
