    Hi there,

    As the title suggests.

    I am a writer and I'm trying to track down what the sentence would be in such a scenario. Specifically, my character has epilepsy and the antibiotic is just one of a number of factors that cause an induced fit.

    Any help would be hugely appreciated.

    You might want to check the Sentencing Guidelines: https://www.sentencingcouncil.org.uk/offences/

    Type in the search box 'drug' and you'll find your answer as a starting point - this is of course assuming the antibiotic is a controlled drug.

      As it turns out the antibiotic isn't a controlled drug according to the list I have found on the government website. Would that mean that there would be no legal penalty at all? The drug is Erythromycin if that is relevant.

        If the antibiotic is a prescription only drug, then you may want to read the Medicines Act 1968: http://www.legislation.gov.uk/ukpga/1968/67/contents

        I'm not familiar with the Act, but I believe it is an offence to supply prescription only drugs.

        Edit: Take a look at Section 67 of that Act, might be of assistance.

        That said, there could be a case of involuntary manslaughter charge

            FYI the Medicines Act 1968 was partially repealed by the Human Medicines Regulations 2012.
            Part 4 is the relevant section for you
