am helping a friend of mine with a huge problem. He invested £70K with a guy who promised him share of his business along with help in establishing his residency in the UK from Turkey. Having paid the monies his so called friend renegaded on the agreement and just ignored him. Having lost his money he started legal proceedings paying £4500 in court fees along. Using a solicitor he issued a online money claim against the debtor - in the claim his solicitor added that particulars of claim would be sent within 14 days of the claim. During this time his solicitor learnt of a conflict of interest and withdrew his service.
My friend went ahead and obtained a judgment by default however the debtor challenged this and the court foi=und that because there were no particulars of claim they would allow the judgment to be set aside. Now the question I have is - can my friend ask the court to restart the process without having to pay the fees he had already paid? and would it be a N22 form he completes to request such?
