The School has a duty of care over your child while in their care and it sounds they may have been negligent in not getting proper medical help when your son was sick - particularly as they are aware of his condition.
Have you made a formal complaint to the School about the situation ? That can then be escalated to Ofsted or the local authority if you're not happy with their response and actions particularly if you have lost confidence that they will act properly should anything similar happen in future with your child ( or others in their care)
Has he continued attending the school since the incident back in July ?

If you want to sue the school for negligence you will need to seek specialist advice from a law firm.
