  • Paid Baliffs as they clamped my car and wasn't my council tax !

    Rossendale Ltd clamped my car as it was on the drive of a house where council tax was owed by my son.
    He kept banging on the windows. When I went out he had clamped my car. He wanted the document to say it was mine. I showed him the reg document then he changed his mind and wanted the proof of purchase ! Of which I couldn't provide him. So he would not unclamp it. He even videoed with out asking me. My son had made an offer to the council and has no income from a buisness he's trying to run and pays himself no wage at all. He had told the council this and he'd no way to pay it just make an offer. He also had paid Rossendales some money a few days before they came.
    He would not unclamp my car so the only way to have it back was to pay £2,800. I wouldn't sign his receipt book!
    it is not my council tax and can I claim this money back ?

    You need to make a formal complaint to the enforcement agent and the council.

      The EA may only take control of goods that belong to the debtor. Before seizing/clamping a vehicle he must show due diligence as to ownership - the first of which should be a check with DVLA. Although the V5 is not proof of ownership it should go a long way to help. An extra complaint to Rossendales suggesting you may make an EAC2 complaint about their Agents behaviour and lack of diligence may help. How did you pay as in my view you were coerced into payment and did not make payment voluntarily to help your son. Don't forget the Council are 100% responsible for the actions and charges of their contractors - involve the local Councillor(s) to bear more pressure.

          It was not voluntary. EACU is a form ? He said I had to prove it was my car. Surely DVLA have that and it's up to them to prove it's of the person they seek? Payment was with bank card and felt coerced yes as my car clamped by a man. Bank said can't refund.
          mid there a word I can use for when a person is vulnerable and coerced into paying something that not their fine at all ?
