    Hi can someone please advise.

    Overstayed in anpr Marks and Spencer car park. Euro Car Parks - EW issued a PCN.

    I was a visitor to the area. Parked car and went to machine to pay only to find it out of order. Had I been able to pay would have realised I was limited to two hours. I went into store to report and returned to car and placed note on windscreen. I returned to car about and hour later with the intention of paying. Machine still out of order. I then continued my shopping and left car park. At this point the machine was still out of order.

    I have appealed to POPLA after both my letters explaining, were in my opinion, not even acknowledged. The first one asked for proof of posting as I had not received their initial demand for £50. The second asking for proof from them, which I understand I am entitled to, that the machine was out of order. Both requests were ignored.

    I have pointed out that as the machine was out of order there was no loss of income to them. If I go to Court what are my chances?

    Hope someone can help......
